Awful estate agents! We had an offer accepted on a property Archers (Daisy) were selling and had started the process and paid the solicitors fees. Archers didn’t put it as sold on the website as agreed when the sellers accepted the offer and they let other buyers view the property and effectively ‘gazump’ us after telling us that we wouldn’t be messed around by the vendors. After speaking with other estate agents for advice, they agreed this is appalling behaviour!
In response to your reply as I can’t reply and yours is complete fiction - that’s not how it was explained at all. They accepted our offer - I have this in writing, there was never any mention of giving us time to be proceedable and our house had been on the market a matter of days. Why would anyone make an offer and pay solicitors if they knew there was a chance someone else could outbid you. They didn’t have to accept our offer if they were not happy that our house wasn’t yet sold. Yes luckily the solicitors are decent and have agreed to refund us through us chasing. I understand that gazumping isn’t illegal but it is unethical. You even advised my husband yesterday that if we were to sell our house we could try and gazump the new buyers - not great practice or advice is it!

Hello Abby,
I am so sorry that you feel let down by us. As you can see from our previous 5 star reviews, we strive for excellent customer service and all reviews are taken very seriously.
As discussed yesterday, no offer is an acceptable offer until the buyer is in a position to proceed (i.e. they have sold their own house or have no house to sell). Whist an offer is not proceedable, some clients may wish to give the potential buyer a period of time for their offer to become proceedable.
In your case, our clients were happy with the offer amount and were willing to give you some time to become ‘proceedable’.
In the meantime another (proceedable) offer was made on the property which - by law - we have to put forward to our clients and take their instructions.
I have spoken with your solicitors and they have confirmed that they have re-imbursed your legal costs fully, as the proceedable purchase process had yet to commence.
Re: the conversation yesterday, I merely explained that if you became proceedable, the law still states that we have to put forward any new offers to the vendor, we never encourage this however are bound by law, so that if you wanted to make a new offer, we would have to forward to our client.
We sympathise with your position, but we have to follow the process and we have to take our clients instructions.
We would love to help you find an alternative property and hopefully you’ll be in a position to make a proceedable offer very soon.
