However, in reply we only fail to return deposits if the potential tenant applying to let a home through us, FAILS the referencing process and this is out of our control as undertaken by a third party referencing company. Failure of refencing is normally, but not always, associated with mis information or incorrect information being supplied on the actual application. We do always try at this stage to help find a solution, but this is not always possible. Referencing is conducted to ensure our landlords are protected and a procedure every lettings agency conducts as a matter of professional integrity and by law. The potential tenant is informed at the time of paying their deposit of their rights and the circumstances behind a deposit payment not being returned.
